十九(jiu)世(shi)紀英國法哲學家梅因說(shuo)過,所(suo)(suo)有(you)進步(bu)社會(hui)的(de)(de)運動(dong)(dong),到(dao)目前為止是(shi)(shi)(shi)(shi)一個(ge)從身份(fen)到(dao)契(qi)約(yue)(yue)(yue)(yue)(yue)(yue)的(de)(de)運動(dong)(dong),簡單理(li)解就(jiu)(jiu)(jiu)是(shi)(shi)(shi)(shi)過去人與人的(de)(de)關(guan)(guan)系(xi)(xi)(xi)是(shi)(shi)(shi)(shi)階級層級關(guan)(guan)系(xi)(xi)(xi)。比(bi)(bi)如奴隸主與奴隸,士大夫與老百姓的(de)(de),都是(shi)(shi)(shi)(shi)以(yi)身份(fen)來(lai)(lai)決定社會(hui)關(guan)(guan)位和彼(bi)此間(jian)關(guan)(guan)系(xi)(xi)(xi),而現代社會(hui)更多的(de)(de)是(shi)(shi)(shi)(shi)平等的(de)(de)契(qi)約(yue)(yue)(yue)(yue)(yue)(yue)關(guan)(guan)系(xi)(xi)(xi),現代化的(de)(de)本(ben)(ben)質就(jiu)(jiu)(jiu)是(shi)(shi)(shi)(shi)由身份(fen)到(dao)契(qi)約(yue)(yue)(yue)(yue)(yue)(yue)的(de)(de)不(bu)斷(duan)進化的(de)(de)歷程,而現代市場經(jing)濟(ji),本(ben)(ben)質上(shang)是(shi)(shi)(shi)(shi)一種(zhong)(zhong)(zhong)契(qi)約(yue)(yue)(yue)(yue)(yue)(yue)經(jing)濟(ji),所(suo)(suo)有(you)的(de)(de)經(jing)濟(ji)往(wang)來(lai)(lai)活動(dong)(dong),都離不(bu)開契(qi)約(yue)(yue)(yue)(yue)(yue)(yue)關(guan)(guan)系(xi)(xi)(xi)的(de)(de)建立(li),比(bi)(bi)如銷售(shou)合(he)(he)同(tong)(tong)、采購協議,包括日常生活當中,這種(zhong)(zhong)(zhong)契(qi)約(yue)(yue)(yue)(yue)(yue)(yue)關(guan)(guan)系(xi)(xi)(xi)也(ye)無處不(bu)在,比(bi)(bi)如結婚領證(zheng)、購房合(he)(he)同(tong)(tong)、貸款協議,形(xing)成契(qi)約(yue)(yue)(yue)(yue)(yue)(yue)關(guan)(guan)系(xi)(xi)(xi)并信(xin)守承諾,也(ye)就(jiu)(jiu)(jiu)是(shi)(shi)(shi)(shi)契(qi)約(yue)(yue)(yue)(yue)(yue)(yue)精神(shen),是(shi)(shi)(shi)(shi)現代文(wen)明的(de)(de)倫理(li)基礎。現代企(qi)業(ye)中,員工(gong)(gong)與企(qi)業(ye)一定是(shi)(shi)(shi)(shi)會(hui)首先建立(li)契(qi)約(yue)(yue)(yue)(yue)(yue)(yue)關(guan)(guan)系(xi)(xi)(xi),所(suo)(suo)以(yi)就(jiu)(jiu)(jiu)會(hui)有(you)了勞(lao)動(dong)(dong)合(he)(he)同(tong)(tong),但員工(gong)(gong)與企(qi)業(ye)關(guan)(guan)系(xi)(xi)(xi)不(bu)僅限于勞(lao)動(dong)(dong)合(he)(he)同(tong)(tong)這一種(zhong)(zhong)(zhong)契(qi)約(yue)(yue)(yue)(yue)(yue)(yue)關(guan)(guan)系(xi)(xi)(xi),經(jing)常聽到(dao)利(li)益共(gong)(gong)同(tong)(tong)體、事(shi)業(ye)共(gong)(gong)同(tong)(tong)體、命運共(gong)(gong)同(tong)(tong)體的(de)(de)說(shuo)法,其(qi)實這也(ye)是(shi)(shi)(shi)(shi)對(dui)應了員工(gong)(gong)與企(qi)業(ye)的(de)(de)三種(zhong)(zhong)(zhong)不(bu)同(tong)(tong)契(qi)約(yue)(yue)(yue)(yue)(yue)(yue)關(guan)(guan)系(xi)(xi)(xi)形(xing)式,員工(gong)(gong)與企(qi)業(ye)到(dao)底是(shi)(shi)(shi)(shi)哪(na)個(ge)共(gong)(gong)同(tong)(tong)體,是(shi)(shi)(shi)(shi)基于雙方之間(jian)的(de)(de)契(qi)約(yue)(yue)(yue)(yue)(yue)(yue)關(guan)(guan)系(xi)(xi)(xi),分別有(you)以(yi)下三種(zhong)(zhong)(zhong)形(xing)式:
一(yi)、雇傭(yong)關系(xi)契約(yue)。比如(ru)勞動合同,約(yue)定工作時(shi)間是每月五(wu)天八小時(shi),工資是八千元(yuan),這(zhe)代(dai)表是公司以(yi)八千元(yuan)的價格購(gou)買了每月五(wu)天八小時(shi)的工作時(shi)間,這(zhe)是一(yi)種簡(jian)單的雇傭(yong)關系(xi),雙方更看(kan)重的是短期價值交(jiao)換,最典型比如(ru):短期工、建筑工人。
二、目標(biao)(biao)責(ze)任契(qi)約(yue)。勞動合同只約(yue)定(ding)了工作時間,但對(dui)工作職(zhi)責(ze)及工作成果(guo)并沒(mei)有清晰而準確(que)的(de)界(jie)定(ding),當需要(yao)對(dui)此(ci)(ci)進行約(yue)定(ding)時,就(jiu)需要(yao)簽訂績效目標(biao)(biao)責(ze)任書,形成目標(biao)(biao)責(ze)任契(qi)約(yue),這是對(dui)雙方(fang)契(qi)約(yue)關系的(de)完善,也是一種升(sheng)級,此(ci)(ci)時雙方(fang)更關注的(de)是互相(xiang)成就(jiu),企業業績增長與員(yuan)工收入增長,及員(yuan)工個人發展互相(xiang)促進相(xiang)輔(fu)相(xiang)成。
三、資本合(he)伙契約。也就是(shi)現在(zai)流行(xing)的(de)(de)合(he)伙人(ren)制,通過(guo)簽訂合(he)伙人(ren)協(xie)議書,員(yuan)工投入個(ge)人(ren)資本,包(bao)括資金、資源、技術等(deng),占有公(gong)司(si)(si)一定股權(quan),從而(er)形成與公(gong)司(si)(si)利益共享風險(xian)共擔的(de)(de)關(guan)系(xi),此時雙(shuang)方會(hui)更關(guan)注公(gong)司(si)(si)長期(qi)的(de)(de)戰略實現,及可持續(xu)發展。
不管(guan)是哪種契約方式,雙方要(yao)秉持的(de)契約精神,既是現代(dai)文明的(de)倫理(li)(li)(li)(li)基礎,也是人力資源(yuan)管(guan)理(li)(li)(li)(li)的(de)理(li)(li)(li)(li)論基石,只有真正(zheng)理(li)(li)(li)(li)解了現代(dai)社會員工與(yu)企業(ye)關系,才(cai)會形成正(zheng)確的(de)企業(ye)人才(cai)理(li)(li)(li)(li)念,從而指導HR各(ge)模塊工作開(kai)展(zhan)。
