加班在(zai)(zai)勞動爭議中每(mei)每(mei)被提起,但是(shi)在(zai)(zai)司法實(shi)踐中,有五種不被認(ren)定為加班的情形,是(shi)大(da)家要(yao)特別注意的。
一(yi)、就是(shi)出(chu)差中的(de)(de)加班。員(yuan)工(gong)認(ren)為的(de)(de)加班時(shi)間(jian)(jian),不(bu)能簡單的(de)(de)以(yi)規定(ding)工(gong)作時(shi)間(jian)(jian)外,還必須以(yi)特定(ding)的(de)(de)工(gong)作內(nei)容(rong)做支(zhi)持,司法中,一(yi)般將勞動(dong)者出(chu)差的(de)(de)在(zai)(zai)途(tu)時(shi)間(jian)(jian)、上下班在(zai)(zai)途(tu)時(shi)間(jian)(jian)、為工(gong)作而進行的(de)(de)準備時(shi)間(jian)(jian)排(pai)除(chu)在(zai)(zai)加班之外,當然有一(yi)些特殊工(gong)作崗位除(chu)外,比如說運鈔員(yuan)。
二(er)、就(jiu)是(shi)值(zhi)班(ban)(ban)(ban)(ban)。值(zhi)班(ban)(ban)(ban)(ban)和(he)(he)(he)加班(ban)(ban)(ban)(ban)都是(shi)法(fa)(fa)定(ding)(ding)的(de)(de)(de)(de)標(biao)(biao)準(zhun)(zhun)工(gong)(gong)作時間(jian)的(de)(de)(de)(de)延長,但是(shi)工(gong)(gong)作性質是(shi)不(bu)同的(de)(de)(de)(de),享受(shou)的(de)(de)(de)(de)待(dai)遇也是(shi)有(you)區別的(de)(de)(de)(de),加班(ban)(ban)(ban)(ban)工(gong)(gong)資有(you)法(fa)(fa)定(ding)(ding)的(de)(de)(de)(de)標(biao)(biao)準(zhun)(zhun),值(zhi)班(ban)(ban)(ban)(ban)報(bao)酬是(shi)協(xie)商的(de)(de)(de)(de),用(yong)人單位應按(an)規章(zhang)制度、集體合(he)同、勞(lao)動合(he)同、企業的(de)(de)(de)(de)慣例等支付相應的(de)(de)(de)(de)待(dai)遇,而值(zhi)班(ban)(ban)(ban)(ban)待(dai)遇并無法(fa)(fa)定(ding)(ding)的(de)(de)(de)(de)*的(de)(de)(de)(de)標(biao)(biao)準(zhun)(zhun),一般而言,值(zhi)班(ban)(ban)(ban)(ban)待(dai)遇會比加班(ban)(ban)(ban)(ban)待(dai)遇低很多,且值(zhi)班(ban)(ban)(ban)(ban)時間(jian)也無上限。所以(yi)這(zhe)里(li)最重要的(de)(de)(de)(de)是(shi)能夠正(zheng)確的(de)(de)(de)(de)辨(bian)別加班(ban)(ban)(ban)(ban)和(he)(he)(he)值(zhi)班(ban)(ban)(ban)(ban),有(you)人說那我就(jiu)可以(yi)把加班(ban)(ban)(ban)(ban)排成(cheng)值(zhi)班(ban)(ban)(ban)(ban),那法(fa)(fa)律(lv)上也有(you)要求,一般是(shi)和(he)(he)(he)員工(gong)(gong)的(de)(de)(de)(de)本(ben)職工(gong)(gong)作無關的(de)(de)(de)(de)工(gong)(gong)作,才能算作值(zhi)班(ban)(ban)(ban)(ban)。
三、就(jiu)是綜合(he)工(gong)(gong)時(shi)。那(nei)么企業計算工(gong)(gong)時(shi)是按照(zhao)一(yi)(yi)定周(zhou)期(qi),如一(yi)(yi)周(zhou)、月(yue)、季(ji)、年(nian)等綜合(he)計算工(gong)(gong)作時(shi)間(jian)(jian),在綜合(he)時(shi)間(jian)(jian)周(zhou)期(qi)內(nei),某(mou)一(yi)(yi)個具體的(de)日(ri)、周(zhou)的(de)實際工(gong)(gong)作時(shi)間(jian)(jian),可(ke)以超過(guo)(guo)八小時(shi)、四十個小時(shi),但綜合(he)計算周(zhou)期(qi)內(nei)的(de)正常工(gong)(gong)作時(shi)間(jian)(jian)沒有(you)超過(guo)(guo)法定標準工(gong)(gong)作時(shi)間(jian)(jian),就(jiu)沒有(you)問(wen)題。
四、未超(chao)勞動(dong)定(ding)額工作時間。企業(ye)依法安排實行計件工資制的勞動(dong)者完(wan)成計件定(ding)額任務后,在法定(ding)標準工作時間以外工作的,應當根(gen)據加班規定(ding)調整計件的單價。
五、就是(shi)員工自動加班。用人(ren)單位安排加班是(shi)認(ren)定加班的關鍵(jian)因(yin)素,非(fei)經用人(ren)單位安排,超過(guo)標準工時制或者是(shi)法定節假日(ri)、周休日(ri)工作的,不(bu)屬于法定意(yi)義上(shang)的加班,用人(ren)單位沒有支付加班費(fei)的義務。
那(nei)在爭(zheng)議發(fa)生(sheng)后,加班(ban)(ban)的事(shi)(shi)實(shi)由誰來(lai)舉證(zheng)呢(ni),勞(lao)動爭(zheng)議調解仲裁法(fa)規定,發(fa)生(sheng)勞(lao)動爭(zheng)議,當事(shi)(shi)人(ren)對自己提(ti)出的主(zhu)張(zhang),有(you)責(ze)任提(ti)供證(zheng)據(ju)。最(zui)高人(ren)民(min)法(fa)院(yuan)關于(yu)審理勞(lao)動爭(zheng)議案件適用法(fa)律若干(gan)問題的解釋三也有(you)說明(ming),那(nei)么勞(lao)動者主(zhu)張(zhang)加班(ban)(ban)費的,應當就加班(ban)(ban)事(shi)(shi)實(shi)的存(cun)(cun)在承擔舉證(zheng)責(ze)任。但勞(lao)動者有(you)證(zheng)據(ju)證(zheng)明(ming)用人(ren)單位掌握(wo)加班(ban)(ban)事(shi)(shi)實(shi)存(cun)(cun)在的證(zheng)明(ming),用人(ren)單位不提(ti)供的。那(nei)么要由用人(ren)單位承擔不利后果,所(suo)以加班(ban)(ban)如未(wei)拿到公司的加班(ban)(ban)審批單。則要有(you)其他能證(zheng)明(ming)加班(ban)(ban)的直(zhi)接的證(zheng)據(ju)才行,不然也有(you)可能被認為假(jia)裝加班(ban)(ban)而(er)得不到加班(ban)(ban)費。
