但是(shi)用人(ren)(ren)單位(wei)(wei)(wei)基于(yu)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)法(fa)的(de)(de)(de)規定(ding)(ding)在勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)中(zhong)對法(fa)定(ding)(ding)解除(chu)(chu)條件可以(yi)進行具體(ti)的(de)(de)(de)量化,這是(shi)可以(yi)的(de)(de)(de)。比如說在勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)中(zhong)明確約定(ding)(ding)勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)嚴重違反用人(ren)(ren)單位(wei)(wei)(wei)規章制度的(de)(de)(de)具體(ti)的(de)(de)(de)情(qing)形是(shi)哪些,并(bing)據此(ci)解除(chu)(chu)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)是(shi)可以(yi)的(de)(de)(de)。用人(ren)(ren)單位(wei)(wei)(wei)還可以(yi)制定(ding)(ding)管(guan)理(li)制度、考(kao)核制度對員工(gong)(gong)的(de)(de)(de)工(gong)(gong)作進行考(kao)核管(guan)理(li),比如對銷售人(ren)(ren)員設定(ding)(ding)符合(he)(he)實際的(de)(de)(de)銷售指標,如果銷售人(ren)(ren)員業績不達標是(shi)員工(gong)(gong)的(de)(de)(de)工(gong)(gong)作能力達不到崗位(wei)(wei)(wei)需(xu)求的(de)(de)(de)表現(xian),也是(shi)不勝任工(gong)(gong)作的(de)(de)(de)表現(xian)。根據勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)法(fa)第四十條的(de)(de)(de)規定(ding)(ding),勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)不勝任工(gong)(gong)作的(de)(de)(de),用人(ren)(ren)單位(wei)(wei)(wei)應先進行培訓(xun)或(huo)調(diao)崗處(chu)理(li),如果培訓(xun)或(huo)調(diao)崗處(chu)理(li)后仍不能勝任的(de)(de)(de),用人(ren)(ren)單位(wei)(wei)(wei)才有權解除(chu)(chu)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong),而(er)且此(ci)種(zhong)情(qing)況下用人(ren)(ren)單位(wei)(wei)(wei)解除(chu)(chu)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)仍是(shi)需(xu)要支付勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)經濟補償的(de)(de)(de)。因(yin)此(ci)銷售員業績不達標并(bing)不能直接(jie)解除(chu)(chu)他的(de)(de)(de)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)。
