應(ying)屆生的人生第(di)一份勞動合同,容易踩的 5 個坑如下:
一(yi)、離職不(bu)會(hui)有違(wei)約金(jin)。不(bu)管是試用(yong)期(qi)還(huan)是轉正(zheng)后,只要想離職,都可放心(xin)大膽地提(ti),即便合同上寫(xie)了(le)相關條款,也(ye)屬違(wei)法,不(bu)會(hui)生(sheng)效(xiao)。
二、證件原件一般(ban)只需復印件。原件別隨便給出去,以免被公(gong)司扣押(ya)。
三、空(kong)白(bai)合同(tong)不要簽。工作地(di)點、崗位、薪(xin)資架構(gou)、試(shi)用期時長、試(shi)用期薪(xin)資等信息應在合同(tong)中有完整體現,確認好(hao)后再(zai)簽,若(ruo)合同(tong)空(kong)白(bai),公(gong)司可隨意(yi)填寫,因已(yi)簽字就會生效。

五(wu)、關(guan)于(yu)(yu)試(shi)用(yong)(yong)期(qi)(qi)(qi)。試(shi)用(yong)(yong)期(qi)(qi)(qi)薪資可打折,但不(bu)能低于(yu)(yu)轉正后的百分之八十。試(shi)用(yong)(yong)期(qi)(qi)(qi)時長有規定(ding),勞動合(he)同期(qi)(qi)(qi)限(xian)(xian)在三個月以(yi)(yi)上(shang)不(bu)滿一(yi)年(nian)(nian)的,試(shi)用(yong)(yong)期(qi)(qi)(qi)不(bu)得超(chao)過(guo)(guo)一(yi)個月;一(yi)年(nian)(nian)以(yi)(yi)上(shang)不(bu)滿三年(nian)(nian)的,試(shi)用(yong)(yong)期(qi)(qi)(qi)不(bu)得超(chao)過(guo)(guo)二個月;三年(nian)(nian)以(yi)(yi)上(shang)固定(ding)期(qi)(qi)(qi)限(xian)(xian)和無固定(ding)期(qi)(qi)(qi)限(xian)(xian)的勞動合(he)同,試(shi)用(yong)(yong)期(qi)(qi)(qi)不(bu)得超(chao)過(guo)(guo)六個月。
具(ju)體畢(bi)業生簽訂勞動(dong)合同時需(xu)要(yao)注意以下方面:
一、必備條款。根據《勞(lao)動(dong)(dong)合同法(fa)》第十七(qi)條規(gui)(gui)定(ding),勞(lao)動(dong)(dong)合同應當具備用(yong)(yong)人(ren)(ren)單位(wei)的名稱、住所(suo)和(he)法(fa)定(ding)代表人(ren)(ren)或者(zhe)(zhe)主要負(fu)責人(ren)(ren);勞(lao)動(dong)(dong)者(zhe)(zhe)的姓(xing)名、住址和(he)居民身份證或者(zhe)(zhe)其(qi)他(ta)有效身份證件(jian)號碼;勞(lao)動(dong)(dong)合同期限;工作內容和(he)工作地點;工作時間和(he)休(xiu)息休(xiu)假(jia);勞(lao)動(dong)(dong)報酬;社(she)會保險;勞(lao)動(dong)(dong)保護、勞(lao)動(dong)(dong)條件(jian)和(he)職業危害防護;法(fa)律、法(fa)規(gui)(gui)規(gui)(gui)定(ding)應當納入勞(lao)動(dong)(dong)合同的其(qi)他(ta)事(shi)項。除前(qian)款規(gui)(gui)定(ding)的必備條款外(wai),用(yong)(yong)人(ren)(ren)單位(wei)與(yu)勞(lao)動(dong)(dong)者(zhe)(zhe)可以約定(ding)試用(yong)(yong)期、培訓、保守秘密(mi)、補充保險和(he)福利待遇等其(qi)他(ta)事(shi)項。
二、簽訂(ding)(ding)(ding)時間(jian)。建立(li)勞(lao)動(dong)(dong)關系(xi),應(ying)(ying)當訂(ding)(ding)(ding)立(li)書(shu)面勞(lao)動(dong)(dong)合同(tong),已(yi)建立(li)勞(lao)動(dong)(dong)關系(xi),未同(tong)時訂(ding)(ding)(ding)立(li)書(shu)面勞(lao)動(dong)(dong)合同(tong)的(de),應(ying)(ying)當自用工(gong)之日(ri)(ri)起(qi)一個(ge)月內訂(ding)(ding)(ding)立(li)書(shu)面勞(lao)動(dong)(dong)合同(tong),用人單位與(yu)勞(lao)動(dong)(dong)者在用工(gong)前訂(ding)(ding)(ding)立(li)勞(lao)動(dong)(dong)合同(tong)的(de),勞(lao)動(dong)(dong)關系(xi)自用工(gong)之日(ri)(ri)起(qi)建立(li)。用人單位自用工(gong)之日(ri)(ri)起(qi)超過(guo) 1 個(ge)月不滿 1 年(nian)未與(yu)勞(lao)動(dong)(dong)者訂(ding)(ding)(ding)立(li)書(shu)面勞(lao)動(dong)(dong)合同(tong)的(de),應(ying)(ying)當向(xiang)勞(lao)動(dong)(dong)者每(mei)月支付二倍的(de)工(gong)資(zi)。
三、合同類型。勞動合同分為固(gu)定期限(xian)、無固(gu)定期限(xian)和以完成一(yi)定工作任(ren)務為期限(xian)三類。
四、試(shi)用(yong)(yong)(yong)(yong)(yong)(yong)期(qi)(qi)規(gui)定。勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)期(qi)(qi)限(xian)三(san)個(ge)月(yue)以(yi)上不(bu)滿(man)一(yi)(yi)(yi)年的(de)(de)(de),試(shi)用(yong)(yong)(yong)(yong)(yong)(yong)期(qi)(qi)不(bu)得(de)超(chao)過(guo)(guo) 1 個(ge)月(yue);勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)期(qi)(qi)限(xian)一(yi)(yi)(yi)年以(yi)上不(bu)滿(man)三(san)年的(de)(de)(de),試(shi)用(yong)(yong)(yong)(yong)(yong)(yong)期(qi)(qi)不(bu)得(de)超(chao)過(guo)(guo) 2 個(ge)月(yue);三(san)年以(yi)上固定期(qi)(qi)限(xian)和無(wu)固定期(qi)(qi)限(xian)的(de)(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong),試(shi)用(yong)(yong)(yong)(yong)(yong)(yong)期(qi)(qi)不(bu)得(de)超(chao)過(guo)(guo) 6 個(ge)月(yue)。同(tong)(tong)一(yi)(yi)(yi)用(yong)(yong)(yong)(yong)(yong)(yong)人單(dan)位與(yu)同(tong)(tong)一(yi)(yi)(yi)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者只能(neng)約定一(yi)(yi)(yi)次試(shi)用(yong)(yong)(yong)(yong)(yong)(yong)期(qi)(qi)。試(shi)用(yong)(yong)(yong)(yong)(yong)(yong)期(qi)(qi)的(de)(de)(de)工資不(bu)得(de)低于本單(dan)位相同(tong)(tong)崗位*檔(dang)工資或(huo)者勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)約定工資的(de)(de)(de) 80%,并不(bu)得(de)低于用(yong)(yong)(yong)(yong)(yong)(yong)人單(dan)位所在地的(de)(de)(de)*工資標準。試(shi)用(yong)(yong)(yong)(yong)(yong)(yong)期(qi)(qi)包(bao)含(han)在勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)期(qi)(qi)限(xian)內,用(yong)(yong)(yong)(yong)(yong)(yong)人單(dan)位應當(dang)自(zi)用(yong)(yong)(yong)(yong)(yong)(yong)工之(zhi)日(ri)起 30 日(ri)內為職工向(xiang)社(she)會(hui)保險經辦機構申(shen)請辦理社(she)會(hui)保險登記。用(yong)(yong)(yong)(yong)(yong)(yong)人單(dan)位不(bu)得(de)無(wu)理由隨意解除與(yu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者在試(shi)用(yong)(yong)(yong)(yong)(yong)(yong)期(qi)(qi)內的(de)(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關系,勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者在試(shi)用(yong)(yong)(yong)(yong)(yong)(yong)期(qi)(qi)間被證明不(bu)符合(he)錄(lu)用(yong)(yong)(yong)(yong)(yong)(yong)條件的(de)(de)(de),用(yong)(yong)(yong)(yong)(yong)(yong)人單(dan)位可以(yi)解除勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)。
五、其(qi)他(ta)注意(yi)事(shi)項(xiang)。避免簽(qian)訂 “自(zi)愿放棄繳納社(she)會(hui)保(bao)(bao)險(xian)費” 的(de)(de)(de)協(xie)議,社(she)會(hui)保(bao)(bao)險(xian)屬于(yu)國(guo)家強制性保(bao)(bao)險(xian),用(yong)(yong)人單(dan)位(wei)(wei)(wei)和勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)必須(xu)依(yi)法(fa)參加(jia)社(she)會(hui)保(bao)(bao)險(xian),繳納社(she)會(hui)保(bao)(bao)險(xian)費;注意(yi)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)是(shi)否(fou)具(ju)備(bei)《勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)法(fa)》規定(ding)(ding)(ding)(ding)的(de)(de)(de)必備(bei)條款,以(yi)及有(you)關用(yong)(yong)人單(dan)位(wei)(wei)(wei)義務和勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)權利的(de)(de)(de)條款是(shi)否(fou)缺(que)失;意(yi)向書不(bu)能代替勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)(tong),勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)一般產(chan)生于(yu)意(yi)向書之后,如果勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)約(yue)(yue)(yue)定(ding)(ding)(ding)(ding)的(de)(de)(de)內(nei)容與意(yi)向書不(bu)一致(zhi),那(nei)么(me)視(shi)為用(yong)(yong)人單(dan)位(wei)(wei)(wei)與勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)就同(tong)(tong)(tong)(tong)(tong)一問題作了(le)新(xin)的(de)(de)(de)約(yue)(yue)(yue)定(ding)(ding)(ding)(ding),應以(yi)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)為準;對于(yu)一些單(dan)位(wei)(wei)(wei)為員工(gong)提供的(de)(de)(de)如出國(guo)進修等特殊培(pei)訓,需注意(yi)服務期(qi)限的(de)(de)(de)約(yue)(yue)(yue)定(ding)(ding)(ding)(ding);用(yong)(yong)人單(dan)位(wei)(wei)(wei)通(tong)常會(hui)將《員工(gong)手冊》、相關規章制度等附在(zai)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)后面,或在(zai)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)中(zhong)約(yue)(yue)(yue)定(ding)(ding)(ding)(ding)上述文(wen)件為附件,經(jing)過確(que)(que)認告知的(de)(de)(de)附件對雙方(fang)(fang)均(jun)有(you)效,雙方(fang)(fang)均(jun)應遵守;勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)應要(yao)求與用(yong)(yong)人單(dan)位(wei)(wei)(wei)訂立書面合(he)(he)(he)同(tong)(tong)(tong)(tong)(tong),并(bing)保(bao)(bao)留一份(fen)合(he)(he)(he)同(tong)(tong)(tong)(tong)(tong),合(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)文(wen)本應由用(yong)(yong)人單(dan)位(wei)(wei)(wei)和勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)各執一份(fen);如果合(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)上的(de)(de)(de)單(dan)位(wei)(wei)(wei)與入(ru)職企業不(bu)一致(zhi),需特別注意(yi)審查中(zhong)間是(shi)否(fou)存(cun)在(zai)第三方(fang)(fang)單(dan)位(wei)(wei)(wei),以(yi)及承包方(fang)(fang)有(you)無履行合(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)的(de)(de)(de)資質和能力等;仔(zi)細閱讀(du)合(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)約(yue)(yue)(yue)定(ding)(ding)(ding)(ding),拒絕簽(qian)訂女(nv)職工(gong)不(bu)得結婚生育、因工(gong)負(fu)傷的(de)(de)(de) “工(gong)傷自(zi)理(li)”、要(yao)求勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)簽(qian)訂生死契約(yue)(yue)(yue)等不(bu)合(he)(he)(he)法(fa)的(de)(de)(de)內(nei)容;注意(yi)合(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)中(zhong)關于(yu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)報酬的(de)(de)(de)構成、工(gong)作崗(gang)位(wei)(wei)(wei)、工(gong)作地點(dian)、支付方(fang)(fang)式與支付時間等信息是(shi)否(fou)明確(que)(que)具(ju)體;在(zai)簽(qian)訂勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)時,要(yao)了(le)解清(qing)楚單(dan)位(wei)(wei)(wei)的(de)(de)(de)基(ji)本情(qing)況(kuang),判斷其(qi)是(shi)否(fou)為合(he)(he)(he)法(fa)企業,并(bing)將相關信息明確(que)(que)寫在(zai)合(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)中(zhong)。
